Terms of Service

1. Binding Agreement
These Terms of Service ("Terms") constitute a legally binding agreement between you and Zyven. By installing, accessing, or using the Zyven application, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

2. License and Intellectual Property
We grant you a personal, non-exclusive, non-transferable, and revocable license to use Zyven for professional career management purposes. All intellectual property rights in the application, including code, design, branding, and proprietary algorithms, are owned by Zyven. You may not reverse-engineer, decompile, or attempt to extract the source code of the application.

3. User-Generated Content and Backups
You retain ownership of all career data and content you input into the app. However, you are solely responsible for the integrity, security, and backup of this content. Zyven does not guarantee that your data will be safe from local device failure, synchronization errors, or loss. We strongly recommend regular manual or cloud-based backups.

4. Third-Party Services and AI Accuracy
Zyven facilitates connections to third-party services, including AI providers and cloud platforms. We do not control, and are not responsible for, the availability, accuracy, or privacy practices of these third parties. Information generated by AI features should be treated as experimental and should be independently verified before being used for critical professional decisions.

5. Disclaimer of Warranties
ZYVEN IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE DEVELOPERS EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZYVEN OR ITS DEVELOPERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. THIS INCLUDES DAMAGES FOR LOSS OF PROFITS, DATA LOSS, REVENUE LOSS, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICE.

SPECIFICALLY, ZYVEN IS NOT RESPONSIBLE FOR:
* Loss of career data stored locally or on cloud providers.
* Inaccuracies in AI-generated content.
* Unauthorized access to your device or iCloud account.
* Service disruptions due to third-party analytics or authentication providers.

7. Indemnification
You agree to indemnify and hold harmless Zyven and its developers from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses, including attorney's fees, arising from your use of the application or your violation of these Terms.

8. Termination
We reserve the right to terminate or suspend your access to Zyven immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

9. Changes to Terms
We may revise these Terms from time to time. The most current version will always be available within the application or on our website. Your continued use of Zyven after revisions become effective constitutes your agreement to the new terms.

10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Zyven is established and operates, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in said region.

The primary language of these Terms and all legal text in the app is English. Translations are provided for convenience and may contain errors. The English version controls in case of any conflict.

AI features may produce inaccurate, incomplete, or outdated results. You must independently verify all outputs before acting on them. Zyven may connect to third-party professional AI service providers to deliver AI features. You are solely responsible for lawful and authorized use of job listings and all analyses. You must not use AI features for unauthorized processing, abuse, or analysis of non-job-listing websites. All decisions, consequences, and legal/compliance obligations remain fully your responsibility.
